Nevada Divorce Guidelines

Nevada's Residency Requirements

Either the petitioner or respondent must have been a Nevada resident for 6 weeks or longer before filing for divorce.

Nevada's Grounds for Divorce

Nevada residents may file for divorce under fault or no-fault grounds.

Nevada's no-fault grounds include:

  • the spouses have lived separate and apart without cohabitation for one year
  • incompatibility

Nevada's fault grounds is:

  • insanity lasting 2 years or longer before filing for divorce.

Nevada's Child Custody Guidelines

Divorcing parents are allowed to collaborate on a child custody arrangement. If the parents cannot reach a decision, a Nevada court will make a ruling.

Nevada courts consider factors such as:

  • any evidence or history of abuse or violence in each parent
  • the wishes of the child, if of sufficient age and mental capacity
  • the wishes of each parent

Nevada's Child Support Guidelines

If the parents cannot agree on the amount of child support and the paying parent, child support will be decided by state-specific calculations and guidelines.

Nevada courts consider factors such as:

  • each parent's income
  • cost of health insurance and childcare
  • each parent's responsibility for supporting others

Nevada's Spousal Support Guidelines

Spousal support can be paid in one lump sum, in installments, or periodically. The spouses may determine the spousal support amount and payment schedule, or the courts may award spousal support.

Nevada courts consider factors such as:

  • duration of the marriage
  • each spouse's financial situation
  • standard of living experienced during the marriage
  • whether one spouse supported or contributed to the other spouse's career, or to the home
  • each spouse's age, health, earning capacity, and income

Nevada's Property Division Guidelines

Nevada has adopted community property division guidelines, meaning all property acquired during the marriage will be divided into two equal parts. Spouses may collaborate on the property distribution, but if they are unable to agree the courts will make a ruling.

Nevada courts will consider factors such as:

  • duration of the marriage
  • each spouse's contribution to the property

Nevada's Venue Guidelines

The petitioner may file the divorce forms in their Nevada county of residence, or in the respondent's Nevada county of residence.

The divorce forms may also be filed in the Nevada county in which the grounds for divorce occurred, or in the Nevada county the spouses last resided in together.
